These Terms of Service (“Terms”) govern your access to and use of mudnfts.com, any related websites, applications, smart contracts, NFT collections, token utilities, and community features operated or provided by MUD Treasury Corp (“MUD Treasury,” “we,” “us,” “our”) related to $MUD™, MUDNFTs™, and the MudVerse Game (collectively, the “Services”).

By accessing or using any part of the Services, you agree to these Terms. If you do not agree, do not use the Services.

You must be 18 years or older (or the age of majority where you live) to use the Services. By using the Services, you represent and warrant that you meet this requirement.

The Services are provided for informational, entertainment, and community utility purposes. Nothing we provide is financial, investment, legal, or tax advice. Digital assets are volatile and risky, and you may lose some or all value. You are solely responsible for your decisions and for compliance with all applicable laws in your jurisdiction.

To use certain features, you may connect a supported Web3 wallet (e.g., Phantom or similar). You are responsible for:

safeguarding your wallet, private keys, and seed phrase,

confirming all transaction details before signing,

paying network fees and understanding transaction finality,

using the correct network and contract addresses.

We do not custody your assets and cannot recover keys, reverse transactions, or restore lost funds.

Blockchain transactions and wallet addresses are typically public. You acknowledge that interactions with smart contracts may be recorded permanently on-chain and may be viewable by anyone.

$MUD™ is a token intended for ecosystem participation and utility as described in the Services and documentation. Utility, features, and availability may change over time and may be restricted or unavailable in some jurisdictions.

No Guarantee

We do not guarantee token utility, price, liquidity, exchange listings, or market value.

When you acquire a MUDNFT, you own the NFT token as recorded on the blockchain (subject to these Terms and any applicable smart contract rules).

IP & Content Rights

Unless expressly stated otherwise in official documentation, acquiring a MUDNFT does not transfer ownership of our trademarks, branding, or underlying intellectual property. You may display your NFT for personal, non-commercial use and for resale purposes consistent with marketplace norms. Any broader commercial use requires written permission from MUD Treasury Corp.

Marketplace Fees / Royalties

NFT secondary sales may be subject to marketplace fees and/or creator royalties where supported. Marketplace settings and enforcement can vary by platform and are not guaranteed.

The MudVerse Game may be released in phases (alpha/beta/production). Features may be delayed, modified, discontinued, or region-restricted.

Game Progression, Rewards, and Balancing

Game systems (including progression, ranks, rewards, seasons, and economy mechanics) may change to maintain balance, prevent abuse, address security risks, or improve gameplay. Rewards are not guaranteed and may be capped, throttled, seasonal, or removed.

Cheating / Exploits

You may not exploit bugs, automate gameplay improperly, manipulate markets, or abuse reward systems. We may reset progress, revoke rewards, restrict access, or take other actions to protect the ecosystem.

You agree not to:

violate laws or regulations,

engage in fraud, deception, market manipulation, or money laundering,

attempt unauthorized access, reverse engineering, or disruption of the Services,

deploy malware, scrape the site excessively, or abuse infrastructure,

impersonate others or misrepresent affiliation,

harass, threaten, or abuse other users/community members.

If you participate in community spaces (Discord/Telegram/X/etc.), you agree to follow posted rules and not to post illegal, harmful, hateful, or abusive content. Moderation decisions are at our discretion.

The Services may integrate with third-party wallets, marketplaces, explorers, analytics tools, or social platforms. We do not control third-party services and are not responsible for their actions, outages, policies, or fees. Use them at your own risk.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Services will be uninterrupted, secure, error-free, or free of harmful components.

TO THE FULLEST EXTENT PERMITTED BY LAW, MUD TREASURY CORP AND ITS OFFICERS, DIRECTORS, CONTRACTORS, CONTRIBUTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR DIGITAL ASSETS ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED $100 USD OR THE AMOUNT YOU PAID TO US DIRECTLY FOR THE SERVICES IN THE PRIOR 12 MONTHS, WHICHEVER IS GREATER (IF APPLICABLE).

You agree to defend, indemnify, and hold harmless MUD Treasury Corp from any claims, liabilities, damages, losses, and expenses (including attorneys’ fees) arising from your use of the Services, your violation of these Terms, or your violation of any law or rights of a third party.

We may suspend or terminate your access to the Services at any time if we believe you violated these Terms, pose a security risk, or if we must do so to comply with law. We may also discontinue any part of the Services at any time.

We may update the Services and these Terms from time to time. Updated Terms will be posted on mudnfts.com with a revised “Last Updated” date. Your continued use after changes means you accept the updated Terms.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. You agree that any dispute will be brought in the state or federal courts located in California, unless otherwise required by applicable law.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
